Marketplace terms
These terms govern use of Botanisia. The seller is the party selling the plant; Botanisia provides the marketplace, order handling and payment facilitation. The contract of sale is between you and the seller, except where the platform is legally the seller of record for a specific transaction.
Prices and charges
Consumer prices are shown in euro and include VAT unless stated otherwise. Shipping is shown before checkout. No mandatory charge is added after the final total. Commission, payment fees and subscription fees are itemised separately in seller records and never disguised as a buyer charge.
Listings and availability
Plants are living products. Sellers must describe the actual specimen, its condition, propagation, size and shipping restrictions honestly. A listing may be paused or removed for compliance, misidentification or a failed payment. Where a unique specimen becomes unavailable after payment, the seller must offer a comparable replacement or a full refund.
Shipping and risk
Sellers configure the countries they ship to and the handling time. Delivery estimates are estimates, not guarantees, and are extended by carrier disruption, weather or customs. Risk passes according to applicable consumer law; a seller cannot contract out of mandatory rights.
Right of withdrawal
EU consumers generally have 14 days to withdraw from a distance contract. The right may be excluded for perishable goods and for sealed goods unsealed after delivery where the law allows. Live plants are handled under the seller’s disclosed policy and applicable law, not by a blanket waiver. See returns.
Seller obligations
Sellers must hold any required plant passport or authorisation, comply with CITES, invasive-species and plant-health rules, provide accurate tax information and respond to buyers. Professional sellers must complete payment-provider identity verification. A two-month trial converts only after clear consent to the disclosed renewal price; cancelling before the renewal date avoids the charge.
Prohibited conduct
No misidentification, counterfeit plants, stolen photographs, fake reviews, off-platform payment requests, harassment or prohibited species. Reports are reviewed by moderators. Serious or repeated breaches can lead to suspension, withholding of payouts pending disputes, and referral to authorities.
Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death, personal injury or fraud. The final limitation-of-liability wording and the governing law must be reviewed for each market before launch.
This is a development draft. The operator’s registered details, dispute body and governing law will be added before the marketplace accepts live orders.
